Preamble

The following information explains which personal data is collected in connection with the use of our website and for what purpose. Personal data refers to all data that can be related to you personally, e.g., name, address, email addresses.

Name and Contact Details of the Controller and the Data Protection Officer

This privacy notice applies to data processing by:

Controller:
Sheffield Tunes GbR (short: Sheffield Tunes)
Neumühlen 17
22673 Hamburg
Germany
Phone: +49 40 6469050
Email: info@scootertechno.com

The data protection officer of Sheffield Tunes can be reached at:
datenschutzbeauftragter@scootertechno.com

Our website is hosted by:
Mittwald CM Service GmbH & Co. KG, Königsberger Straße 4–6, 32339 Espelkamp (short: Mittwald).
Further information can be found in Mittwald’s privacy policy: https://www.mittwald.de/datenschutz

The use of Mittwald is based on Art. 6(1)(f) GDPR, as we have a legitimate interest in a reliable presentation of our website. If consent has been obtained, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.

We have concluded a data processing agreement (DPA) with the above-mentioned service provider. This contract ensures that the personal data of our website visitors is processed only according to our instructions and in compliance with the GDPR.

3. Collection and Storage of Personal Data and the Nature and Purpose of Their Use

a) When Visiting the Website

Visiting our website is generally possible without providing personal data.

However, when you access our website, the browser used on your device automatically sends information to our website’s server. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automated deletion:

  • IP address of the requesting computer
  • Date and time of the server request
  • Name and URL of the accessed file
  • Website from which the access is made (referrer URL)
  • Browser used and, if applicable, the operating system of your computer and the name of your access provider

These data are processed for the following purposes:

  • Ensuring a smooth connection to the website
  • Ensuring comfortable use of our website
  • Evaluation of system security and stability
  • Improvement of our services

The legal basis for data processing is Art. 6(1)(f) GDPR. Our legitimate interest follows from the purposes listed above. Under no circumstances do we use the collected data to draw conclusions about your person.

In addition, we use cookies and analytics services when you visit our website. Further details can be found in sections 5 and 10 of this privacy policy.

b) When Subscribing to Our Newsletter

With your consent, you can subscribe to our newsletter, which informs you about our current offers. The advertised goods and services are specified in the declaration of consent.

The newsletter is sent via “MailChimp,” a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

We use the so-called double opt-in procedure for newsletter registration. This means that after your registration, we send an email to the provided address asking for confirmation that you wish to receive the newsletter. This confirmation is necessary to ensure that no one can register with someone else’s email address. Newsletter registrations are logged to be able to prove the registration process in accordance with legal requirements. This includes storing the registration and confirmation time as well as the IP address. Changes to your data stored with MailChimp are also logged. If you do not confirm your registration within 24 hours, your information will be blocked and automatically deleted after one month.

The only required information for sending the newsletter is your email address. Providing additional, separately marked data is voluntary and used to address you personally. After your confirmation, we store your email address for the purpose of sending the newsletter.

The email addresses of our newsletter subscribers, as well as other data described in this notice, are stored on MailChimp’s servers in the USA. MailChimp uses this information to send and evaluate the newsletters on our behalf. According to MailChimp, the data may also be used to optimize or improve their own services, e.g., for technical optimization of the mailing and the display of the newsletter or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to contact them themselves or to pass them on to third parties.

MailChimp is certified under the EU-US Privacy Shield: https://www.privacyshield.gov/EU-US-Framework

MailChimp’s privacy policy can be viewed at: https://mailchimp.com/legal/privacy/

The legal basis is Art. 6(1)(a) GDPR.

You can revoke your consent to receive the newsletter at any time and unsubscribe. You can declare the revocation by clicking the link provided in every newsletter email or by contacting us via the contact details provided in the imprint.

Please note that we analyze your user behavior when sending the newsletter. For this analysis, the emails contain so-called web beacons or tracking pixels, which are one-pixel image files stored on our website. For the analysis, we link the data mentioned in section 3 a) and the web beacons with your email address and an individual ID. With the data obtained in this way, we create a user profile to tailor the newsletter to your individual interests. We record when you read our newsletters, which links you click in them, and infer your personal interests. We link this data with actions you have taken on our website.

You can object to this tracking at any time by clicking the separate link provided in each email or by contacting us via another communication channel. The information is stored as long as you are subscribed to the newsletter. After unsubscribing, the data is stored purely statistically and anonymously.

c) When Contacting Us via Email or Contact Form

When you contact us via email or the contact form provided on our website, the data you provide (your email address, possibly your name and phone number) will be stored by us to process your request or answer your questions.

To use the contact form, a valid email address is required so that we know who the request is from and can respond. Additional information can be provided voluntarily.

Data processing for the purpose of contacting us is based on Art. 6(1)(a) GDPR on the basis of your voluntarily given consent.

We delete the data arising in this context once storage is no longer necessary, e.g., because your inquiry has been resolved, or restrict processing if there are statutory retention obligations.

d) When Applying Online

If you apply to us online via the application form provided on our website, we process the personal data you submit (application data), in particular:

  • First and last name
  • Address
  • Phone number
  • Email address
  • Application documents (cover letter, CV, certificates, etc.)

exclusively for the purpose of filling positions within our company. Any further use of your application data does not take place.

These personal data are generally deleted automatically three months after the application process has been completed, provided your application was not successful. Deletion after the three-month period does not occur if legal provisions prevent deletion, if the data must be stored for the assertion, exercise, or defense of legal claims, or if you have expressly consented to longer storage.

The legal basis for data processing is Art. 6(1)(a) and (f) GDPR.

Disclosure of Data

Your personal data will not be transferred to third parties for purposes other than those listed below.

We only share your personal data with third parties if:

  • You have given your express consent pursuant to Art. 6(1)(a) GDPR
  • The disclosure is necessary pursuant to Art. 6(1)(f) GDPR for the establishment, exercise, or defense of legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data
  • There is a legal obligation for disclosure pursuant to Art. 6(1)(c) GDPR
  • It is legally permissible and necessary for the performance of a contract with you pursuant to Art. 6(1)(b) GDPR

Your application data submitted as part of your online application will generally only be forwarded to the internal departments and specialist units responsible for the specific application process.

Cookies

We use cookies on our website. These are small text files that your browser automatically creates and stores on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not cause any damage to your device, nor do they contain viruses, trojans, or other malware.

The cookie stores information related to the specific device used. However, this does not mean that we gain direct knowledge of your identity.

The use of cookies serves, on the one hand, to make the use of our services more pleasant for you. For example, we use so-called “session cookies” to recognize that you have already visited individual pages of our website. These are automatically deleted after you leave our site.

We also use temporary cookies to optimize user-friendliness, which are stored on your device for a specified period. If you visit our site again to use our services, it is automatically recognized that you have already been with us and what inputs and settings you made, so you do not have to enter them again.

The data processed by cookies is necessary for the purposes mentioned to protect our legitimate interests and those of third parties in accordance with Art. 6(1)(f) GDPR.

Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or a warning always appears before a new cookie is created. Completely disabling cookies may mean that you cannot use all the features of our website.

To manage the cookies and similar technologies (tracking pixels, web beacons, etc.) used and the related consents, we use the consent tool “Real Cookie Banner.” Details on how “Real Cookie Banner” works can be found at: https://devowl.io/de/rcb/datenverarbeitung.

The legal bases for processing personal data in this context are Art. 6(1)(c) GDPR and Art. 6(1)(f) GDPR. Our legitimate interest lies in managing the cookies and similar technologies and the related consents.

Providing personal data is neither legally nor contractually required. You are not obliged to provide personal data. However, if you do not provide the data, we cannot manage your consents.

Google Analytics

This website uses the service “Google Analytics” provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). The service uses “cookies.” These cookies allow Google to analyze your use of our website. The information generated by the cookies about your use of this website and your IP address is usually transmitted to and stored on a Google server in the USA.

If IP anonymization is activated on this website, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before transmission. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, compile reports on website activity, and provide other services related to website usage to the website operator.

This website uses Google Analytics with the extension “anonymizeIp()”. This ensures that IP addresses are processed in a shortened form, excluding direct personal reference.

For exceptional cases in which personal data is transferred to the USA, Google is certified under the EU-US Privacy Shield: https://www.privacy-shield.gov/EU-US-Framework

You can prevent the storage of cookies by adjusting your browser settings. However, please note that if you do this, you may not be able to use all features of this website to their full extent. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google and the processing of this data by Google by downloading and installing the browser plug-in available at: https://tools.google.com/dlpage/gaoptout?hl=de

We use this tracking measure to ensure a needs-based design and continuous optimization of our website. We also use it to statistically record the use of our website and evaluate it for the purpose of optimizing our services. These interests are considered legitimate under the aforementioned regulation.

This measure is carried out based on Art. 6(1)(f) GDPR.

Social Media Plug-ins

We use social media plug-ins from the social networks Facebook, Twitter, Instagram, and Pinterest on our website based on Art. 6(1)(f) GDPR to increase awareness of our company. The underlying promotional purpose is to be regarded as a legitimate interest under the GDPR. The responsibility for data protection-compliant operation lies with the respective providers.

The integration of these plug-ins is done using the so-called two-click method. This means that when you visit our website, no personal data is initially passed on to the plug-in providers. You can recognize the provider of the plug-in by the marking on the box above its initial or logo. We give you the opportunity to communicate directly with the provider of the plug-in via the button. Only if you click on the marked field and thereby activate it, will the respective plug-in provider receive the information that you have accessed the corresponding page of our website. The data mentioned in section 3 a) of this declaration will also be transmitted. By activating the plug-in, personal data is therefore transmitted to the respective plug-in provider and stored there.

a) Facebook (“Like” Button)

We use plug-ins from the social network Facebook, operated by Facebook Inc., 1601 Willow Road, Menlo Park, CA 94205, USA. Facebook plug-ins are recognizable by a Facebook logo (e.g., white “f” on a blue tile, “thumbs up” symbol) or are marked with “Facebook Social Plug-in.” Details on the functions and appearance of the plug-ins can be found at: developers.facebook.com/docs/plugins

Facebook stores the data collected about you as user profiles and uses them for advertising, market research, and/or needs-based design of its website. You have the right to object to the creation of such user profiles, and you must contact Facebook to exercise this right.

Data is transmitted regardless of whether you have a Facebook account or are logged in. If you are logged in, your data will be directly associated with your Facebook account. If you click the activated button (e.g., “LIKE”), this information will also be stored in your user account and shared publicly with your contacts. We recommend logging out of Facebook after use, especially before activating the button, to avoid association with your profile. You can also block Facebook plug-ins using browser add-ons (e.g., “Facebook Blocker”).

For more information, see Facebook’s privacy policy: https://www.facebook.com/about/privacy/

Facebook is certified under the EU-US Privacy Shield: https://www.privacy-shield.gov/EU-US-Framework

b) Instagram

We also use plug-ins from Instagram, operated by Instagram LLC, 1601 Willow Road, Menlo Park, CA 94025, USA. The plug-ins are marked with an Instagram logo, such as an “Instagram camera.”

Data is transmitted regardless of whether you have an Instagram account or are logged in. If you are logged in, Instagram can directly associate your visit to our website with your Instagram account. If you interact with the plug-ins, this information is also transmitted to an Instagram server and stored there. It is also published on your Instagram account and shown to your contacts.

If you do not want Instagram to associate the data collected via our website with your account, you must log out before visiting our site.

These videos are all embedded in “privacy-enhanced mode,” which means that no data about you as a user is transmitted to YouTube if you do not play the videos. Only when you play the videos will the data mentioned in section 3 a) of this policy be transmitted. We have no influence over this data transmission.

When you visit a page on our website that contains a YouTube plug-in, YouTube receives the information that you have accessed the corresponding subpage of our website. https://www.privacyshield.gov/EU-US-Framework

The legal basis for the use of YouTube is Art. 6(1)(f) GDPR.

Google Maps

We use the Google Maps service on our website. This allows us to display interactive maps directly on the website and enables you to conveniently use the map function.

The maps are embedded in a way that no data about you as a user is transmitted to Google unless you access the maps. Only when you do so will the data mentioned in section 3 a) of this policy be transmitted. We have no influence over this data transmission.

When you visit a page on our website that contains a Google Maps plug-in, Google receives the information that you have accessed the corresponding subpage. This occurs regardless of whether you are logged into a Google account. If you are logged in, your data may be directly associated with your account. If you do not want this, you must log out before activating the map.

Google stores your data as usage profiles and uses them for advertising, market research, and/or the personalized design of its website. You have the right to object to this profiling by contacting Google.

We use the widespread SSL (Secure Socket Layer) protocol during website visits in conjunction with the highest level of encryption supported by your browser. Typically, this is 256-bit encryption. If your browser does not support 256-bit encryption, we fall back on 128-bit v3 technology.
